At its website www.sporthuette.at, Sporthütte Fiegl GmbH, Dorfstraße 119, 6450 Sölden offers the possibility to rent winter sports equipment online. In addition, insurance can be taken out for damage, breakage or theft of the rented products. For ski course bookings within the All-in-One packages, Sporthütte Fiegl acts only as an intermediary and is not liable for any price or course changes. The customer is bound to his or her booking.
Pricing
Product prices appear in the first section of the booking process. It is possible to cancel the booking process at this time. The prices include applicable taxes and duties. They shall be denominated and debited in EUR.
Payment
The price can be paid by credit card (Visa, MasterCard, AmericanExpress) and Sofortüberweisung (an instant bank transfer service).
Booking confirmation, issuing of vouchers
With the booking, the customer confirms the correctness of his/her personal data. The booking made by the customer is only considered accepted when the customer has received confirmation from Sporthütte Fiegl GmbH.
The customer is obliged to check this confirmation immediately for correctness. Any deviations from the booking must be reported to Sporthütte Fiegl GmbH immediately.
Withdrawl, cancellation
Cancellation of the booking is possible in writing under the following conditions:
- If the cancellation is made up to 10 working days before the first rental day, a cancellation fee of 15% of the booked equipment or service will be retained as a cancellation fee.
- If the cancellation is made 3-9 working days before the first rental day, a cancellation fee of 25% of the booked equipment or service will be retained.
- If the cancellation is made 1 or 2 working day(s) prior to the first rental day, a cancellation fee of 35% of the booked equipment or service will be retained as cancellation fee.
- Cancellation from the first day of booking: No refund will be granted if the customer is in default of acceptance. In the event of illness or accident, the customer may withdraw from the contract upon presentation of a medical certificate and receive a refund of the rental price paid.
Collection and return of equipment
The customer can pick up the equipment from 3 pm on the day before the first day of the rental by presenting a photo ID and the booking confirmation. The return must take place on the last rental day before the close of business. Should the equipment be used longer than booked, the difference will be charged according to local conditions and has to be paid directly in the shop. If the equipment or parts thereof are not returned on time, Sporthütte Fiegl GmbH reserves the right to charge a corresponding additional fee. The customer must ensure that the equipment is returned in perfect condition.
Exchange
The rented equipment can be upgraded to a higher category by paying the difference. In case of an exchange into a lower category, money will be refunded by Sporthütte Fiegl GmbH.
Usage
The customer must use the equipment in accordance with its function and operating conditions. Defects that are already apparent at the time of rental entitle the customer to free replacement in the same category. Should this not be possible, both contracting parties may withdraw from the agreement. Passing on the equipment to third parties is prohibited. We expressly draw notice to the dangers of an unauthorized exchange of skis, e.g. with regard to the setting of the ski bindings. The customer is responsible for the protection of the equipment against theft or mix-up. There is no insurance coverage for this.
Therefore, the customer is also liable to Sporthütte Fiegl GmbH for repair costs and current value in case of breakage, damage or theft. Exception: A liability assumption by the renting agent was agreed in advance.
Insurance in Case of Damage, Breakage or Theft of Rented Equipment
If the customer has selected the "Insurance" option, the following additional conditions shall apply:
In principle, the customer is liable to the rental company in case of damage, breakage or theft. Subject of this contract is the assumption of this liability by Sporthütte Fiegl GmbH in case of damage, breakage or theft.
For a fee Sporthütte Fiegl GmbH assumes liability in case of breakage, non-intentional damage or theft. In case of theft a police report is required. Without insurance, the current value of the rental equipment will be charged.
The customer must inform Sporthütte Fiegl of any damage immediately. The damage report includes the booking number, name and address of the customer and the rental shop, the location of the damage or theft, a description of the accident, a description of the equipment and a theft report to the responsible police station or confirmation of the damage by the rental shop and the names and addresses of any witnesses.
The agreement applies only to the equipment and booking period specified in the booking confirmation. In the event of theft or breakage during a subsequently agreed extension, Sporthütte Fiegl GmbH is free of liability. In the case of a quality upgrade, Sporthütte Fiegl GmbH is only liable for the value of the originally rented equipment in the event of damage or theft. The difference shall be borne by the customer.
Sporthütte Fiegl GmbH accepts no liability for damage caused by improper use of the sports equipment. In addition, Sporthütte Fielg GmbH is not liable for personal injury and damage to the property of the customer or third parties. If the customer gives the rented equipment to a third party, the lender is also not liable for damage. Sporthütte Fiegl GmbH also does not provide compensation for wear and tear caused by normal use (e.g. repair of surfaces, waxing or grinding of edges).
Sporthütte Fiegl GmbH charges a fee of 3,50 Euro per day for adults and 1,50 Euro per day for youths and children. The fee is to be paid in advance and will be debited with the payment.
